Health Committee Ranking Members Urge CMS to Withdraw NBPP Proposed Rule

On March 11, 2026, House Committee on Energy and Commerce Ranking Member Frank Pallone (D-NJ-06), House Committee on Ways and Means Ranking Member Richard Neal (D-MA-01), House Committee on Education and Workforce Ranking Member Bobby Scott (D-VA-03), and Senate Committee on Finance Ranking Member Ron Wyden (D-OR) sent a letter to the Centers for Medicare & Medicaid Services (CMS) Administrator Mehmet Oz expressing opposition to the Trump Administration’s proposed changes to the Affordable Care Act (ACA) Marketplace.

In the letter, the Members state that the Notice of Benefit and Payment Parameters (NBPP) Proposed Rule for the 2027 plan year (PY), released by the Department of Health and Human Services (HHS) on February 9, 2026, would decrease enrollment in the ACA Marketplace and increase premiums, deductibles, and out‑of‑pocket costs for enrollees. Notably, they warn that the proposal would prohibit insurers from covering routine adult dental health services as an Essential Health Benefit (EHB), rolling back health insurance coverage of routine dental care. They also emphasize that oral health plays a “critical role in overall health and quality of life.”

Impact on General Dentistry: The NBPP proposed rule would limit states’ ability to require adult dental coverage as an EHB and may reduce access to comprehensive dental care for adults in certain insurance markets. AGD will continue to monitor CMS rulemaking and advocate for policies that support access to oral health care.
